What we do

Full expert services, start to finish.

We can pick up an engagement at any stage. Most often, counsel retains us early so the report and the testimony are built on the same foundation.

Report writing

Detailed written opinions that walk the trier of fact through the OSHA standards at issue, the record evidence, and our analysis. Plain English. Footnoted to the standard.

Deposition

Sworn testimony under cross. We have done this. We do not improvise. Every opinion in our report has a citation, and we will say so on the record.

Trial testimony

Direct, cross, and demonstrative aids when the case goes the distance. We work with counsel on voir dire prep and on translating the standards for a jury.

How we work

We do not pick a side. We read the record.

Our opinion does not change based on who hired us. The OSHA standards are written down. The record evidence is what it is. The analysis follows from both.

We have worked plaintiff and defense engagements. We will tell you, on the call, whether your facts support a strong opinion or whether the standard cuts the other way. If we cannot help, we will say so before the retainer is signed.

That predictability is the point. Counsel on either side can call us, get a straight read, and decide whether to retain us knowing the opinion will be the same after we have read everything.

Case types

What we take, and what we don't.

We work general industry only. If your case is outside that scope, we will say so on the first call and refer you to a specialist.

What we take

General industry cases under OSHA 29 CFR 1910. Most often:

  • Machine guarding and lockout/tagout
  • Fall protection (general industry, walking-working surfaces)
  • Hazard communication and chemical exposure
  • Personal protective equipment
  • Electrical safety and arc flash
  • Confined space entry
  • Heat illness and ergonomic injury
  • OSHA recordkeeping and reporting

What we don't take

Cases outside general industry. These need a specialist and we will refer:

  • Construction (29 CFR 1926)
  • Mining (MSHA jurisdiction)
  • Maritime and longshoring
  • Agriculture
