Visited by OSHA?

Has your business recently undergone an inspection by an OSHA Compliance Safety and Health Officer (CSHO)? If so, it’s important to understand that the inspection process doesn’t end with the initial site visit and closing conference. In fact, the CSHO is granted up to six months to thoroughly analyze the findings, compile their report, and submit it to the OSHA Area Director for review. Upon receiving the report, the Area Director is responsible for determining whether any violations have occurred, assessing the severity of each violation based on the CSHO’s findings, and assigning appropriate penalties. This information is subsequently relayed back to the employer, who is then given an opportunity to respond.

At this critical juncture, we strongly recommend scheduling an informal conference with the Area Director to engage in a constructive dialogue regarding the identified violations and potential penalty amounts. Open communication can be instrumental in clarifying any misunderstandings and achieving a favorable resolution.
